Welcome to novefic! novefic is a digital reading platform (hereinafter referred to as "this platform" or "novefic") dedicated to providing a high-quality novel reading experience. Please read this agreement carefully. This agreement contains important provisions on dispute resolution methods, liability limitations, etc., which may affect your legitimate rights and interests.

1. Scope of Agreement

1.1 Scope of Agreement and Covered Services

The <novefic User Agreement> governs your access to and use of our services by any means, including but not limited to: the novefic official website, the novefic mobile application for iOS, Android, and other compatible operating systems, the novefic content or features you access through third-party platforms or integrated functions (such as social media links, embedded readers), and all free and paid services, content, and features provided by novefic.

1.2 Rules for Acceptance and Effectiveness of User Agreement

By downloading, installing, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including the novefic Privacy Policy.

If you do not agree to all the terms of this Agreement, or are not eligible to use the Services for any reason stated in this Agreement, you are expressly prohibited from using the Services, and you must immediately cease using them.

By using the novefic service, you voluntarily accept this Agreement; this Agreement shall come into effect upon your first use of the service and shall be legally binding on both parties. Meanwhile, you shall ensure that you have the civil capacity to enter into this Agreement.

1.3 Amendment Rights and Notification Rules of Agreement Terms

novefic reserves the right to unilaterally modify the terms of this Agreement in accordance with the requirements of laws and regulations, the needs for service optimization, or business adjustment situations.

For significant modifications involving changes to core service rules or user rights and obligations, novefic will notify users through at least one of the following methods: posting an announcement in a prominent location on the application or official website, sending a notification to the email associated with the account, and updating the "Last Updated Date" at the top of the agreement.

The revised terms shall come into effect 14 calendar days after the date of the notice's issuance (or immediately if otherwise provided by law). If you continue to use the services after the new terms come into effect, you shall be deemed to have accepted the revised terms; if you do not agree, you shall stop using the services and apply for account cancellation in accordance with Article 4.3 of this Agreement.

1.4 Qualifying Conditions for Service Access and Use

You must meet all of the following conditions to access or use the novefic service:

Age Requirement: You must be at least 13 years old (or the higher legal age required by your jurisdiction, such as 16 years old as stipulated by the European Union's General Data Protection Regulation). If you do not meet this minimum age, you must use this service under the affirmative consent and supervision of your parent or legal guardian, and the guardian must accept this Agreement on your behalf.

Historical Usage Record Requirement: You have not previously had your service usage suspended or terminated for violating this Agreement, unless you have obtained written permission from novefic.

Compliance Requirements: When registering for and using the services, you must comply with all applicable local, national, and international laws and regulations (including copyright laws, data protection regulations, etc.).

Enterprise/Organization User Requirements: If you use this service on behalf of a company, organization, or other entity, you must ensure that you have sufficient authority to enter into this Agreement on behalf of that entity, ensure that the entity meets the above eligibility requirements, and ensure that the entity strictly complies with all terms of this Agreement.

1.5 Qualification Verification and Violation Handling Authority

novefic reserves the right to verify your eligibility to use the service at any time.

If it is found that you do not meet the eligibility criteria for use (for example, you are under 13 years old and do not have guardian consent), novefic reserves the right to suspend or terminate your account and handle relevant data in accordance with applicable privacy laws and regulations.

2. Account registration and management

2.1 Account Management Specification

To use novefic's specific features such as saving reading progress, subscribing to paid content, and posting comments, you need to register an account. When registering, you should provide accurate, up-to-date, and complete personal information (such as email address, password, payment information, etc.), which should be updated in a timely manner after changes. novefic has the right to refuse or disable account names, usernames, or personal profile information that violate content guidelines (such as offensive, misleading, or infringing content), impersonate others or entities, or contradict brand perception or legal obligations.

Your account is for personal use only, and you must not disclose or share account credentials (such as username, password, two-factor authentication code, etc.) with any third party. You are solely responsible for three things: first, maintaining the confidentiality of account info; second, being accountable for all activities under the account (such as purchases, comments, content uploads); third, immediately notifying novefic via the contact information listed in   Article 20 of the Agreement upon discovering unauthorized account access or use.  novefic shall not be liable for any losses, damages, or unauthorized operations resulting from your failure to properly safeguard account info; if it suspects unauthorized access, it may take measures such as resetting the password or suspending the account.

You may apply to cancel your account at any time through the relevant functions in the "Account Settings" of the application or official website, but please note three points: first, account cancellation is an irreversible operation; second, you will permanently lose access to all account-related data (such as saved reading lists, subscription benefits, user-generated content, etc.) after cancellation; third, you must settle all outstanding payments or unfulfilled obligations (such as unpaid subscription fees). In addition, in accordance with applicable laws (such as tax record retention requirements) or to safeguard novefic's legitimate rights and interests (such as fraud prevention), it may continue to retain necessary account data after account cancellation. For specific details, please refer to the "Privacy Policy".

2.2 Third-party login

You can choose to use third-party authentication services (such as Google, Apple, Facebook, etc.) to register or log in to your account. By using third-party login, you agree to:

1. Authorize the third party to share specific information (such as name, email address, etc.) with novefic for account creation and management.

2. Comply with the third party's Terms of Service and Privacy Policy;

3. Confirm that novefic is not responsible for any issues (such as account suspension, data leakage, etc.) caused by third-party services.

2.3 Account Suspension and Termination

novefic reserves the right, in its sole discretion, to suspend, restrict or terminate your account in the following circumstances:

1. Violation of this Agreement, the Privacy Policy or the Content Guidelines;

2. Received a request with legal effect (such as a court order).

3. You have not logged in or used the service for 18 consecutive months (novefic will notify you by email at least 30 days before termination);

There are situations suspected of fraud, illegal or abusive behavior.

If your account is terminated for violating this Agreement, you may not re-register without novefic's written permission.

3. Access to and use of the service

3.1 License of Use

Subject to this Agreement, novefic grants you a personal, non-exclusive, non-transferable, non-sublicensable limited license to access and use the Service solely for your personal, non-commercial purposes. The license includes:

1. Read free or subscription content on the platform.

2. Use the reading progress saving and personal reading list functions.

3. Post comments and interact with other users within the scope allowed by the function.

You may not use this service for any commercial purpose, including but not limited to:

1. Sell, rent, or license novefic content to third parties.

2. Promote or sell goods/services through this platform (except as expressly authorized in writing by novefic);

3. Capture and collect platform user data or content, or use it for commercial profit.

3.2 Use restrictions

You may not engage in the following behaviors:

1. Modify, adapt, reverse engineer, decompile or disassemble any part of the application or website (including software code, application programming interfaces, user interfaces, etc.);

2. Accessing, collecting, or processing platform data using automated tools (such as robots, crawlers, grabbers, etc.) without novefic's written permission.

3. Interfering with or disrupting the normal operation of this service (such as launching DDoS attacks, uploading malicious software, excessive consumption of server resources, etc.);

4. Avoid novefic's access control mechanism (such as using VPN to bypass regional content restrictions, sharing subscription credentials to bypass paywalls, etc.).

Using this service in violation of any applicable laws (such as disseminating pirated content, posting harmful information, etc.).

3.3 Devices and Networks

When using novefic services, you must prepare yourself:

1. Compatible devices that meet the minimum system requirements of novefic (please refer to the instructions on the app store or official website for specific requirements).

2. Stable internet connection (data charges are charged by your network service provider);

3. The latest operating system and browser software to ensure the security and functionality of the service.

novefic is not responsible for any service obstacles caused by device incompatibility, network connectivity issues, or outdated software.

4. Subscription Service Rules

4.1 Free and Paid Services

novefic offers free services and premium subscription services:

1. Free Service: Includes limited content access and basic reading functions, and may display advertisements. novefic reserves the right to modify, suspend, or terminate the Free Service at any time without prior notice.

2. Paid subscription service: provides exclusive content access, ad-free reading, offline downloads and other advanced features (specific benefits vary by subscription plan). Subscription services must comply with the following terms.

4.2 Subscription and Payment Management Specifications

1. By subscribing to the novefic paid plan, you agree to pay the subscription fee at the rate displayed at the time of purchase (including applicable taxes); choose the billing period provided by the platform (such as monthly or annual payment); and provide you with valid payment methods that you are entitled to use (such as credit/debit cards, digital wallets, etc.). In addition, the platform may launch promotional plans such as free trials and discount offers, and relevant additional terms (such as automatic renewal after the trial period) will be clearly disclosed when you subscribe.

3. Unless you actively turn off auto-renewal, paid subscriptions will automatically renew at the end of each billing cycle. To avoid incurring charges in the next cycle, you must turn off auto-renewal at least 24 hours before the end of the current billing cycle, which can be managed through the novefic account settings or the third-party platform where you purchased the subscription (such as Apple App Store, Google Play Store). If auto-renewal fails due to reasons such as an expired payment method, the platform will notify you and may suspend paid services until the issue is resolved.

4. Billing and payment rules are as follows: Monthly subscriptions are debited on the corresponding day of the initial purchase date each month; if that day does not exist, it will be the last day of the month; annual subscriptions are debited on the same date each year. You authorize novefic (or its third-party payment processor) to deduct funds from your designated payment method at the start of each billing cycle; you can update your payment method through account settings, and if the default payment method fails to deduct funds, the platform may deduct funds from other payment methods associated with your account.     Subscriptions purchased through third-party platforms must comply with the billing terms of that platform, and payment management, cancellation, and refund must be processed through the third party.

5. Regarding cancellation and refund, you may cancel your paid subscription at any time. The cancelled subscription will remain valid until the end of the current billing cycle, after which access will revert to the free service. Unless otherwise required by law or explicitly stated in a promotional activity, subscription fees are non-refundable once paid, and no pro-rata refund will be provided for cancellations made mid-cycle. Refund requests must be submitted within 30 days after the deduction via the contact information specified in Article 20 of this Agreement or through the third-party billing platform, and novefic reserves the right to approve or reject refund requests at its sole discretion.

novefic may adjust the subscription price up to 30 days in advance via email or in-app notification. If you do not accept the new price, you must cancel your subscription before the adjustment takes effect. Continuing to use the service after the adjustment takes effect will be deemed as acceptance of the new price.

5. Content Terms

5.1 Content Ownership

novefic Content: All content provided by novefic or its licensors (including novels, illustrations, trademarks, software, platform design, etc.) is protected by global copyright, trademark, and other intellectual property laws, and is owned by novefic or its licensors.
Unless expressly permitted by this Agreement or authorized in writing by the relevant rights holder, you may not use, copy, distribute, modify, display, perform, or create derivative works based on novefic Content.

User-Generated Content (UGC): If you post, upload, or share content (such as comments, book reviews, fan fiction, original stories, etc.) on the platform, you retain the intellectual property rights to such content (subject to third-party rights). By submitting UGC, you grant novefic a global, non-exclusive, royalty-free, transferable, and sublicensable license for the following purposes:

1. Use, copy, distribute, modify, display, and promote services related to the UGC (such as displaying comments on story pages, promoting original content in marketing materials, etc.);

2. Store and archive the UGC for operational and optimization purposes.
Unless you legally request the deletion of the UGC (and within the technically feasible scope), this license remains valid after account cancellation. You hereby represent and warrant that:

3. You have the right to submit this UGC (i.e., you are the rights holder or have obtained authorization);

4. This UGC does not infringe upon any third-party rights (such as copyright, trademark rights, privacy rights, portrait rights, etc.);

5. This UGC complies with this Agreement and Content Guidelines (if it does not contain illegal or offensive content).

novefic reserves the right to review, edit, or delete UGC at its sole discretion without prior notice.

5.2 Content Statement

novefic does not guarantee the permanent availability of any content (including the platform's own content and user-generated content UGC), and content may be modified or removed due to reasons such as the expiration of the Licensing Agreement, author requests, legal obligations, correction of accuracy or quality issues (such as correcting spelling mistakes, updating translations), as well as regional licensing restrictions or age-based access restrictions. For the removal of major content such as popular serialized stories, the platform will make every effort to notify users, but will not be liable for any losses or inconveniences caused by such removals.

novefic does not make any warranties regarding the accuracy, quality, or suitability of platform content (including UGC). The views expressed in the content (such as story perspectives, comments, etc.) solely represent the author or user and do not represent the platform's position. You shall bear the risks associated with accessing and using the content on your own. The platform may add warning labels to certain content (such as content containing explicit language, violence, or sensitive topics), but such labels are for reference only and do not constitute comprehensive or accurate warnings. Parents or guardians should supervise the content access behavior of juveniles.

6. Platform Reviews and User Interaction

novefic advocates that users communicate with mutual respect, and when posting comments, reviews, and other UGC, they must not submit content that is illegal, harmful, threatening, abusive, defamatory, discriminatory, pornographic, violent, inciting hatred, infringing on third-party rights, spam, unauthorized advertising, misleading, impersonating others or entities, or violating content guidelines or applicable laws; the platform may use your comments for service operation and promotion, does not guarantee permanent storage, and may delete or archive comments due to technical, legal, or operational reasons, and you should back up comments you need to retain on your own; the platform may independently decide to manage comments, including pre- and post-publication review, editing/hiding/deleting non-compliant comments, restricting or disabling the commenting privileges of repeat offenders, but has no obligation to review all comments, and failure to remove non-compliant content does not constitute approval, and if you find inappropriate comments, you can report them through the "Report" function within the app or website.

7. Third-Party Products and Services

7.1 Third-Party Integration

This platform may contain links to third-party websites, services, or content, or integrate third-party tools (such as analytics, payment processing, etc.). Such integrations are provided solely for the convenience of users, and novefic does not control, endorse, or guarantee the accuracy, security, or legality of third-party products/services.

7.2 Use of Third-Party Services

Accessing or using third-party services through novefic indicates your consent to:

1. Comply with the third party's terms and Privacy Policy;

2. Confirm that novefic shall not be liable for any losses, damages, or disputes caused by third-party services (such as data breaches, fraudulent websites);

3. Be aware that the personal information shared with this third party is     subject to its Privacy Policy, rather than novefic's Privacy Policy.

7.3 Third-Party Advertising

Free services may display third-party advertisements. novefic does not endorse any products/services advertised, nor is it responsible for the accuracy or legality of the advertisement content. Advertisers bear full responsibility for their advertisement content, and transactions between you and advertisers are independent of novefic.

8. Prohibited Conduct

Except as provided in Articles 5.2 and 8.1, you shall not:

1. Engages in fraudulent activities (such as creating fake accounts, using stolen payment methods, or manipulating the platform to obtain unauthorized content/benefits);

2. Harm others (such as harassing, stalking, threatening users or novefic employees, inciting self-harm or violence);

3. Unauthorized access (such as attempting to hack into others' accounts, data, or functions, or attacking servers);

4. Interfering with services (such as sending excessive messages, sending junk emails to users, or overloading servers with automated requests);

5. Violation of laws (such as spreading pirated content, money laundering, and violating export controls).

novefic may take immediate action against violators, including terminating accounts, reporting to authorities, and assisting law enforcement.

9. Limitation of Liability and Disclaimer

9.1 Services are provided "as is"

novefic Service is provided on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to:

1. Warranty of merchantability, fitness for a particular purpose, and non-infringement;

2. Guarantee of uninterrupted service, error-free operation, security, or virus-free status;

3. Assurance of content accuracy, completeness, or timeliness.

You shall bear the risks associated with your use of this service on your own. novefic does not guarantee that the service will meet your expectations, nor does it guarantee that all errors will be corrected.

9.2 Limitation of Liability

To the fullest extent permitted by law, novefic and its affiliates, licensors, officers, directors, employees, and agents shall not be liable for the following:

1.Any direct, indirect, incidental, special, consequential, or punitive damages;

2. Losses of profit, revenue, data, or use;

3. Equipment damage or content loss;

4. Damage caused by a third party.

The above limitations shall apply regardless of the legal theory (contract, tort, negligence, etc.) upon which liability is based, even if novefic has been informed of the possibility of such damages.

9.3 Exceptional Situations

Nothing in this Agreement shall exclude or limit novefic's liability for the following circumstances:

1. Death or personal injury caused by gross negligence;

2. Fraud or fraudulent misrepresentation;

3.Liabilities that cannot be excluded or restricted under applicable laws (such as consumer protection obligations).

10. Legal Compliance

10.1 User Compliance Obligations

You agree to comply with all applicable local, national, and international laws when using the services, including:

1. Copyright, trademark, and other intellectual property laws;

2. Data Protection Laws (such as EU GDPR, US CCPA);

3. Anti-junk email laws (such as the US CAN-SPAM Act);

4. Export control laws (such as US EAR, European Union Dual-Use Items Regulations).

You are responsible for ensuring that your use of the service complies with local laws (such as age restrictions for specific content).

10.2 Novefic Compliance

novefic complies with applicable laws, including:

1. Respond to valid intellectual property notices and remove infringing content (see Article 15);

2. Protect user data in accordance with the Privacy Policy and data protection laws;

3. Report illegal activities to the authorities as required by law.

If the law mandates the disclosure of your information (such as a court order), novefic will comply in good faith and will not be liable to you for such disclosure.

11. Violation Handling and Compensation

If novefic discovers or receives reports regarding your violations, it may notify you within a reasonable period and request correction (such as removing infringing UGC), and may take immediate action for serious violations such as fraud, harassment, and dissemination of illegal content. If you fail to correct in a timely manner or have serious violations, novefic may suspend or terminate your account, remove or disable access to your UGC, prohibit you from using the service in the future, take legal action (such as filing a lawsuit for copyright infringement or fraud), or report your actions to law enforcement or regulatory authorities. Meanwhile, you shall indemnify novefic for all losses, damages, or expenses (including reasonable attorney's fees) resulting from the breach of contract.

You agree to defend, indemnify, and hold harmless novefic and its affiliates, licensors, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of the following matters: your access to or use of the novefic Services, your breach of this Agreement, applicable laws, or third-party rights, your UGC (such as when novefic is sued for defamation due to your comments), and disputes arising out of this Service between you and other users or third parties; if novefic assumes the defense of a claim, you shall provide reasonable cooperation.

12. Intellectual Property Protection and Infringement Handling

12.1 Requirements for Infringement Notices

novefic respects intellectual property rights and will respond to valid infringement notices. If you believe that the content on the platform infringes your rights, please submit a written notice to novefic's designated agent (contact information can be found in Article 20), including the following:

1. Your physical or electronic signature;

2. Detailed description of the infringed work;

3. The specific location of the infringing content on the platform;

4. Your contact information;

5. A statement of good faith asserting that you believe the use is not authorized by law or the rights holder;

6. Legal commitment regarding the authenticity of the notice content.

12.2 Counter-Notice Requirements

If you believe your content has been wrongly removed, you may submit a counter-notice, including the following:

1. Your signature;

2. Description of the removed content and its original location;

3. Your contact information;

4. You are convinced that the removal was due to a misguided statement of good faith;

5. Agree to the jurisdiction of the relevant court and accept service of legal documents.

12.3 Response of novefic

Upon receipt of a valid infringement notice, novefic will:

1. Promptly remove or disable relevant content;

2. Notify the content provider and provide a copy of the notice (excluding confidential information).

3. Upon receiving a valid counter notice, novefic will:

4. Notify the original notifier;

5. If the original notifier fails to initiate legal proceedings within 10 - 14 working days, the removed content will be restored.

novefic may terminate the accounts of repeat infringers.

13. Effectiveness and Amendment of the Agreement

13.1 Divisibility

If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced, to the extent possible, with a valid provision that reflects the original intent.

13.2 Reservation of Rights

novefic's failure to enforce any provision of this Agreement or to pursue a breach of contract does not constitute a waiver of its rights. Any waiver shall only become effective after being in writing and signed by novefic.

13.3 Complete Agreement

This Agreement, together with the Privacy Policy, Content Guidelines, and other referenced documents, constitutes the entire agreement between you and novefic regarding the Services, superseding all previous oral or written agreements, understandings, or representations.

14. Governing Law and Dispute Resolution

14.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, US, without regard to its conflict of laws principles. This choice of law shall apply regardless of where you access the Services.

14.2 Arbitration

Compulsory Arbitration: Except for disputes falling within the jurisdiction of small claims courts, any dispute, claim, or dispute between you and novefic arising out of this Agreement or the Services shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the US Arbitration Association (AAA) (or the Consumer Arbitration Rules for Consumer Disputes).

Class action waiver: Both parties waive the right to resolve disputes through class action, collective arbitration, or representative litigation. Arbitration can only adjudicate individual disputes.

14.3 Emergency relief

Article 17 does not limit the right of either party to apply to the court for interim injunctive relief for infringement, but such relief does not affect the arbitration resolution of the dispute.

15. Privacy Policy

novefic attaches great importance to the protection of your personal information. The Privacy Policy details how we collect, use, store and disclose your personal data (such as account info, reading habits, payment details, etc.). The Privacy Policy forms part of this Agreement, and your use of the Service constitutes acceptance of its terms.

In the event of a conflict between this Agreement and the Privacy Policy regarding the handling of personal information, the Privacy Policy shall prevail.

16. Termination of service

16.1 User active termination

You can terminate the service in the following ways:

1. Cancel the account in accordance with Article 4.3.

2. Stop accessing applications and websites.

Termination of the Agreement does not relieve you of your obligations (such as unpaid subscription fees) prior to termination.

16.2 novefic termination

novefic may terminate all or part of the services or your access rights under the following circumstances (with or without notice):

1. Business needs (such as function discontinuation, regional market withdrawal).

2. Legal requirements (such as government directives);

3. You have seriously violated this Agreement (see Section 13.2).

If novefic terminates the service without cause, the prepaid unused fees will be refunded, except as otherwise provided by law.

17. General Terms

17.1 Notification

All notices between the parties shall be made in writing. novefic may give notice to you in the following ways:

1. Sent to the email address associated with your account;

2. In-app push notifications;

3. Announcement prominently displayed on the website or application.

4. You should use the contact information in this article to notify novefic. The notice shall be deemed served:

5. Email and in-app notifications: When sent;

6. Website/Application Announcement: When Published.

You are obliged to ensure that your email address is valid. novefic shall not be liable for any failure of notice delivery due to an outdated email address.

17.2 Transfer by Agreement

novefic reserves the right to assign this Agreement, in whole or in part, to a third party (such as in the case of a merger or asset sale) without your consent.
